These Terms of Service ("Terms") govern your access to and use of the Water Drop mobile application ("App") and related services ("Services") operated by Thinking Studio LLC ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
You must be at least 13 years of age to use the App. If you are under 18, you should use the App only with the involvement of a parent or guardian. By using the App, you represent that you meet these requirements.

The App is designed for personal, non-commercial use as a daily mindfulness and reflection tool. It is not a substitute for professional medical, psychological, or therapeutic advice.
Prices may vary by region. All payments are processed through the Apple App Store. You agree to Apple's payment terms and conditions.
We may offer a 7-day free trial of Premium. At the end of the trial, your subscription will automatically convert to a paid Premium subscription unless you cancel before the trial ends. You can manage or cancel your trial in your Apple ID subscription settings.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel subscriptions in Settings > [Your Name] > Subscriptions in the App Store.
Refund requests are handled by Apple. We do not process refunds directly. Please contact Apple Support for subscription refunds. We may, at our discretion, consider exceptional circumstances — contact us at support@waterdrop.life.
We may change subscription prices. Price changes will apply to new subscriptions and to renewals after the change takes effect. We will notify you of any price change. Continued use after the change constitutes acceptance.
The App uses artificial intelligence to generate personalized content, including morning fables, wisdom letters, Ocean conversations, and sleep suggestions. You understand and agree that:

Premium users earn "drops" by completing sessions. Drops contribute to a community pool. When the pool reaches a target (e.g., 250,000 drops), we donate a set amount (e.g., $25 USD) to a verified water charity to support clean water access.
Your use of the App and accumulation of drops does not constitute a direct donation from you. Drops are a measure of engagement. The donation is made by Thinking Studio LLC at our discretion when a pool is completed. We are not a charity; we are a for-profit company that commits to donating a portion of our resources based on community engagement.
We aim to be transparent about donations. When a pool is completed, we may display donation details and receipts in the App. The choice of charity, timing, and amount are at our discretion. We do not guarantee that any specific charity will receive funds or that donations will occur on a fixed schedule.
Because you are not making a direct donation, you cannot claim a tax deduction for your use of the App or your drops.
When you use the App, you may provide content such as your name, answers to questions, and conversations with The Ocean. This content is stored locally on your device unless we explicitly state otherwise. We do not sell your personal data.
To generate personalized content, we may send certain information (e.g., your answers, mood selections, conversation text) to third-party AI service providers. This is described in our Privacy Policy. By using AI features, you consent to this processing.
You retain ownership of the content you create. By using the App, you grant us a limited license to process, store, and use your content as necessary to provide the Services and improve the App, in accordance with our Privacy Policy.
We are not responsible for loss of your locally stored data due to device failure, uninstallation, or other circumstances. We recommend backing up important content yourself.

The App, including its design, branding, content (except user-generated content), and technology, is owned by Thinking Studio LLC. "Water Drop," "The Ocean," and related marks are our trademarks. You may not use our trademarks or branding without our written permission.
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using the App, you also agree to our Privacy Policy. The Privacy Policy is available at waterdrop.life/privacy.
THE APP AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT WARRANT THAT AI-GENERATED CONTENT WILL BE ACCURATE, APPROPRIATE, OR SUITABLE FOR YOUR SITUATION.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
You agree to indemnify, defend, and hold harmless Thinking Studio LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
You may stop using the App at any time. Cancelling your subscription will end your Premium access at the end of your current billing period.
We may suspend or terminate your access to the App at any time, with or without cause or notice, including for violation of these Terms.
Upon termination, your right to use the App ceases. Provisions that by their nature should survive (including Sections 9, 11, 12, 13, and 16) will survive termination.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App or on our website, and by updating the "Last updated" date. Your continued use of the App after changes take effect constitutes acceptance of the new Terms. If you do not agree, you must stop using the App.
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Wyoming.
For any dispute, you agree to first contact us at support@waterdrop.life to attempt to resolve the matter informally. If we cannot resolve it within 30 days, either party may pursue legal remedies.
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Thinking Studio LLC regarding the App and supersede any prior agreements.
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
You may not assign or transfer these Terms or your rights under them. We may assign our rights and obligations without restriction.
